    MUTT MADNESS 2022 

    OFFICIAL CONTEST RULES 

     

    These rules apply to the Mutt Madness 2022 Contest (“Contest”) conducted by Beasley Media Group, LLC d/b/a WKML (“Station”). In addition, the General Contest Rules posted at www.wkml.bbgistage.com apply to this Contest. If there is a conflict between the General Contest Rules and the Rules for this Contest, the Rules for this Contest shall control. 

     

    1. HOW TO ENTER  

     

    1. The Contest will begin on Friday, March 11, 2022 and will end on Thursday, March 17, 2022.  

     

    1. To enter online, visit www.wkml.bbgistage.com and follow the links and instructions to enter the Contest and complete and submit the online entry form including a photo of your dog (“Photo”) beginning on Friday, March 11, 2022 at 4:00pm Eastern Time (“ET”) and ending at Thursday, March 17, 2022 at 12:00p.m. noon ET (“Online Entry Period”).  Online entrants are subject to all notices posted online including but not limited to the Station’s Privacy Policy. Limit one (1) entry per eligible person during the Online Entry Period regardless if entrant has more than one email address. Multiple entrants are not permitted to share the same email address. Entries submitted may not be acknowledged or returned. Proof of submission of an entry shall not be deemed proof of receipt by the Contest administrator.   

     

    1. Photos must be in gif, jpeg, jpg, or png and may not be larger than 500 MB.  Entrants must fill in all required fields, including name, email, phone number and date of birth in the online entry form. Obscene, provocative, or otherwise objectionable content will not be considered, and such determination is solely at the discretion of the Station. A pet may only be entered a maximum of one (1) time. 

     

    1. Each Photo submitted may feature only the pet and must not contain copyrighted materials or any other materials that may be restricted, prohibited, or outlawed by any laws, or materials that may otherwise infringe on the rights of a third party. Entrant acknowledges and agrees that professional photographs (i.e., photographs taken by a photographer who was paid to take such photographs) are not eligible unless the entrant has rights to post that Photo.  The Photo may not invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights including but not limited to copyrights or trademarks. The Station shall have the right to disqualify any entrant if it determines that the Photo contains copyrighted material or material that infringes on the rights of another; indecent or otherwise offensive material such as violence or drug abuse; or if such Photo contains material that is deemed to be unsuitable for a public audience. The Station’s determinations with respect to all such matters shall be made in its sole discretion and shall be final. Photos that do not comply with these rules will not be eligible for the Contest.  By submitting a Photo, all entrants agree that they have permission to post the Photo and grant Station permission to post their Photo on www.wkml.bbgistage.com for promotional purposes.  

     

    1. There will be up to a total of one (1) winner selected in the Contest.  

     

    1. ELIGIBILITY RESTRICTIONS 

     

    1. This Contest is open to all Station listeners who are 18 years of age or older, own or foster a dog as of the date of entry into the Contest, who are legal US residents and reside in North Carolina, except where prohibited by law. Winners must possess a valid, government-issued ID and show proof of residency to verify eligibility. Station may require winner to provide proof of dog ownership/foster care upon request. 

     

     

    1. PRIZES 

     

    1. Up to one (1) Prize will be awarded.  The Prize consists of two (2) tickets to the WKML Stars and Guitars concert in November 2022.  Approximate Retail Value of the Prize is $100.  The winner will be solely responsible for all taxes and all other fees and expenses not specified herein associated with the receipt and use of the prize(s). The prize(s) is awarded as is. Tickets valid only on the date(s) printed on the tickets. Tickets are not refundable or transferable, and may not be substituted or exchanged for cash or credit at any time, nor will tickets be replaced if lost or stolen. Tickets may not be sold to a third party. If a prize-related event is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, including for weather, or for any reason beyond control of the Station and/or prize provider, their sole responsibility to the winner(s) will be to award the remaining available elements of the prize(s) and no substitution or compensation will be provided for the unawarded element(s) of the prize(s). The Station and/or venue, in their sole discretion, reserve the right to deny entry to or to remove the winner(s) and/or guest(s) if either engages in disruptive behavior, does not follow Station and/or venue policy regarding COVID-19 guidelines, or in a manner with intent to annoy, abuse, threaten or harass any other person at the prize-related event. Winner understands that there are inherent risks involved in attending the prize-related event. 

     

    1. Prizes or prize certificates must be claimed at the office of the Station located at 1876 Bureau Dr., Fayetteville, NC 28312, Monday-Friday, during regular business hours. Prize or prize certificate must be claimed within thirty (30) days of winning. Failure to claim Prize by the specified time will result in forfeiture of the prize. It is the winner’s sole responsibility to claim the Prize or prize certificate within the timeline provided in these Official Rules.  

     

     

    1. SELECTION OF WINNERS 
    1. Up to sixty-four (64) total Photo entries will be selected on Thursday, March 17, 2022 at approximately 2 p.m. ET in a Station-conducted random drawing from all eligible Photo entries received during the Online Entry Period.  Selected Photos will be randomly placed in a sixty-four (64) Photo bracket. In the case that sixty-four (64) Photo entries aren’t submitted, the highest of the following numbers (four (4), eight (8), sixteen (16), and thirty-two (32)) of Photo entries submitted will be selected and used for the bracket voting portion of this Contest as described below. 

     

    1. The sixty-four (64) randomly selected Photos will be randomly paired up and voted on until there is one (1) remaining entry. Voting period is as follows:  

     

    1. Round 1 sixty-four (64) Photos: will begin on Friday, March 18, 2022 from 6 a.m. ET until Tuesday, March 22, 2022 at 11:59 p.m. ET. In each matchup, the Photo with highest votes will advance to Round 2. 
    1. Round 2 – thirty-two (32) Photos: will begin on Wednesday, March 23, 2021 from 12 a.m. ET until Sunday, March 27, 2022 at 12 p.m. ET. In each matchup, the Photo with highest votes will advance to Round 3. 
    1. Round 3 – sixteen (16) Photos: will begin on Sunday, March 27, 2022 at 12:01 p.m. ET until Tuesday, March 29, 2022 at 11:59 p.m. ET. In each matchup, the Photo with highest votes will advance to Round 4. 
    1. Round 4 – eight (8) Photos: will begin on Wednesday, March 30, 2022 at 12 a.m. ET until Friday, April 1, 2022 at 12 p.m. ET. In each matchup, the Photo with highest votes will advance to Round 5. 
    1. Round 5 – four (4) Photos: will begin on Friday, April 2, 2022 at 12:01 p.m. ET until Sunday, April 3, 2022 at 11:59 p.m. ET. In each matchup, the Photo with highest votes will advance to Round 6. 
    1. Round 6 – two (2) Photos: will begin on Monday, April 4, 2021 at 12 a.m. ET until Wednesday, April 6 at 3 p.m. ET. The Photo with the highest number of votes once Round 6 has concluded will be deemed the prize winner, upon confirmation of eligibility. Potential Prize winner will be notified by phone and/or email on or around April 7, 2022.  

    Any ties are automatically broken by random selection of the two tied entries. 

     

    1. Odds of being selected to be placed in the Contest bracket depend on the number of eligible online entries received during the Online Entry Period. 

       

    1. Entrants need not listen to the Station or be present to win. 

     

    1. Winner must confirm acceptance of prize within seven (7) days of winning, or risk disqualification and selection of an alternate winner (time permitting) from the Photo entrant who was deemed the runner-up.   

     

    1. Decisions of Station management with respect to the Contest are final. 

     

    1. CONDITIONS 

     

    1. The Station reserves the right to end any contest or amend these rules upon announcement on air and by publication at www.WKML.com.  

     

    1. For website contests: By use of the Station’s website and by entering this Contest, entrants agree to the Station’s Terms of Service Agreement and to the use of Personal Information as stated in the Privacy Policy located at www.WKML.com. 

     

    1. Copies of the written Contest rules and a list of all winners are available during regular business hours at the main studio of the Station, 1876 Bureau Drive, Fayetteville, NC 28312, or by sending a self-addressed, stamped envelope to the Station.

    Entries are “received” when the National Sponsor’s computer logs the completed entry form. Other proof of submitting an entry (such as a screenshot of a “thanks for entering” message) does not constitute actual receipt of the entry for purposes of this National Sweepstakes. National Sponsor’s clock will be the official timekeeper for this National Sweepstakes.

    Limit one (1) entry per person/email in this National Sweepstakes. Subsequent attempts made by the same individual to submit multiple entries in violation of this condition by using multiple email accounts or by any other method or means are void and persons engaging in such conduct may, in National Sponsor’s sole discretion, be disqualified. As a condition of entering the National Sweepstakes, without limiting any other provision in these Official Rules, each entrant gives consent for Sponsor and its agents to obtain and deliver his or her name, address, and other information and content to third parties for the purpose of administering this National Sweepstakes and complying with applicable laws, regulations, and rules.

    ODDS AND WINNER SELECTION/NOTIFICATION: One (1) National Sweepstakes prize winner will be selected in a random drawing from among all eligible entries received for this National Sweepstakes. The drawing will take place Tuesday, March 1, 2022 at 11am CT. Odds of winning a prize depend on the number of eligible entries received.

    Within approximately five (5) business days of the prize drawing, Sponsor will attempt to contact the potential winner at the email address provided at the time of entry. The potential winner will be required to respond to Sponsor as instructed within forty-eight (48) hours of Sponsor attempting to contact the potential winner as described above.

    If any prize, prize notification, or National Sweepstakes-related communication is rejected, faulty, or returned as undeliverable or if the potential winner does not respond according to the notification’s or National Sponsor’s instructions or otherwise fails to comply with these Official Rules, the prize may, in National Sponsor’s sole discretion, be forfeited and an alternate winner may be selected (time permitting). Sponsor is not responsible for any change in entrant’s email address or communications that are segregated into a junk or other folder. Upon prize forfeiture, no compensation will be given and Sponsor will have no responsibility or liability to that participant. To claim a prize, each potential winner must follow the directions in his or her notification. Sponsor reserves the right to modify the notification procedures in connection with the selection of an alternate potential winner, if any.

    Potential winner will be required to complete, sign, have notarized (if applicable) and return an Affidavit of Eligibility and Liability/Publicity Release (unless prohibited by law) and tax documents (collectively, “Prize Winner Documents”) in the form provided by Sponsor, without revision, or prize may be forfeited. The Prize Winner Documents must be received by Sponsor within five (5) days of Sponsor sending the documents to the potential winner or other time frame as stated in the Prize Winner Documents, or prize may be forfeited and an alternate winner may be selected. The prize claim and Prize Winner Documents are subject to verification by Sponsor. The prize, if legitimately claimed, will be awarded. Sponsor will not be obligated to pursue more than three (3) alternate winners (time permitting) for the prize for any reason, in which case that prize may go unawarded.

    PRIZES & APPROXIMATE RETAIL VALUE (“ARV”):

    One (1) winner will receive “$5,000” awarded in the form of a check for $5,000 made payable to the winner. ARV: $5,000. National Sponsor makes no representation that the prize will cover any costs, debts or other financial obligations of the winner.

    All prize details not specifically stated in these Official Rules will be determined by Sponsor in its sole discretion. All taxes (federal, state, and local, if any) are the sole responsibility of the winner. Winner will receive an IRS Form 1099 for the ARV of the prize. Prize will be mailed to the winner following verification at the address provided by winner in the Prize Winner Documents.

    No transfers, prize substitutions or cash redemptions will be made, except at National Sponsor’s sole discretion. Sponsor reserves the right to substitute stated prize or portion thereof with another prize or portion thereof of equal or greater value for any reason, including, without limitation, prize unavailability. No more than the stated prize will be awarded. Entrants waive the right to assert, as a cost of winning any prize, any and all costs of verification and redemption or travel to claim the prize and any liability and publicity which might arise from claiming or seeking to claim said prize.

    LIMITATION OF LIABILITY:

    TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, EACH PARTICIPANT AGREES TO RELEASE, HOLD HARMLESS, AND INDEMNIFY EACH OF THE RELEASED PARTIES FROM AND AGAINST ANY LIABILITY WHATSOEVER FOR INJURIES OR DAMAGES OF ANY KIND SUSTAINED IN CONNECTION WITH THE ACCEPTANCE, USE, MISUSE, OR AWARDING OF THE PRIZE OR WHILE PREPARING FOR, PARTICIPATING IN, AND/OR TRAVELING TO OR FROM ANY PRIZE- OR CHALLENGE-RELATED ACTIVITY INCLUDING, WITHOUT LIMITATION, ANY INJURY, DAMAGE, LOSS, DEATH OR ACCIDENT TO/OF PERSON OR PROPERTY. THE LIMITATIONS SET FORTH IN THIS SECTION WILL NOT LIMIT OR EXCLUDE THE RELEASED PARTIES’ LIABILITY FOR PERSONAL INJURY OR TANGIBLE PROPERTY DAMAGE CAUSED BY THE RELEASED PARTIES, OR FOR THE RELEASED PARTIES’ GROSS NEGLIGENCE, FRAUD, OR INTENTIONAL, WILLFUL, MALICIOUS, OR RECKLESS MISCONDUCT.

    TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EACH WINNER AGREES THAT THE PRIZE IS PROVIDED AS-IS WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF THE PRIZE, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.

    EACH PARTICIPANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE UNITED STATES ARE HEREBY EXPRESSLY WAIVED BY HIM/HER. SECTION 1542 READS AS FOLLOWS:

    “CERTAIN CLAIMS NOT AFFECTED BY A GENERAL RELEASE. A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”

    ADDITIONAL DISCLAIMERS:

    Released Parties are not responsible and/or liable for any of the following, whether caused by a Released Party, the entrant, or by human error: entries that are submitted by illegitimate means (such as, without limitation, by an automated computer program) or entries in excess of any stated limit; any lost, late, incomplete, illegible, unintelligible, garbled, mutilated, or misdirected entries, email, mail, or other correspondence or materials or postage-due mail; any error, omission, interruption, defect or delay in transmission or communication; viruses or technical or mechanical malfunctions; interrupted or unavailable cable or satellite systems; errors, typos, or misprints in these Official Rules or the official rules for a Local Promoter Sweepstakes, in any advertisements, or other materials; failures of electronic equipment, computer hardware, or software; lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications. The Released Parties are not responsible for electronic communications that are undeliverable or otherwise not received or noticed by entrant as a result of any form of active or passive filtering of any kind, or insufficient space in entrant’s email or voicemail inbox to receive email or voicemail messages. Released Parties are not responsible, and may disqualify you, if your email address, or other contact information does not work or is changed without prior written notice to Sponsor. Without limiting any other provision in these Official Rules, Released Parties are not responsible or liable to any entrant or winner (or any person claiming through such entrant or winner) for failure to supply a prize or any part thereof in the event that any of the National Sweepstakes activities or Released Parties’ operations or activities are affected by any cause or event beyond the sole and reasonable control of the applicable Released Party (as determined by Sponsor in its sole discretion), including, without limitation, by reason of any acts of God, equipment failure, threatened or actual terrorist acts, air raid, act of public enemy, war (declared or undeclared), civil disturbance, insurrection, riot, epidemic, fire, explosion, earthquake, flood, hurricane, unusually severe weather, blackout, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, any law, rule, regulation, action, order, or request adopted, taken, or made by any governmental or quasi-governmental entity (whether or not such governmental act proves to be invalid), or any other cause, whether or not specifically mentioned above.

    GENERAL RULES:

If the National Sweepstakes is not capable of running as planned for any reason, Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the National Sweepstakes and award the prizes from eligible, non-suspect entries received prior to cancellation, modification, or suspension or as otherwise deemed fair and appropriate by Sponsor. If any person supplies false information, obtains entries by fraudulent means, or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any prize, Sponsor may disqualify that person and seek damages from him or her and that person may be prosecuted to the full extent of the law. In the event of a dispute concerning the identity of a participant, the participant will be declared to be the registered account holder of the email address provided at the time of entry, but only if that person meets all other eligibility criteria, otherwise the entry may, in National Sponsor’s sole discretion, be disqualified and any potential prize won forfeited. A registered account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. EITHER PARTY MAY, NOTWITHSTANDING THIS PROVISION, BRING QUALIFYING CLAIMS IN SMALL CLAIMS COURT.     Further, in any such dispute, under no circumstances will you be permitted or entitled to obtain awards for, and hereby waive all rights to claim, incidental or consequential damages. The prior limitation on damages is not intended to limit the Released Parties’ obligation (if any) to pay prevailing party costs or fees if recoverable pursuant to applicable law.

    OFFICIAL CONTEST RULES 

     

    These rules apply to the WKML Pass the Gas Contest (“Contest”) conducted by Beasley Media Group, LLC d/b/a WKML-FM (“Station”). In addition, the General Contest Rules posted at www.WKML.com apply to this Contest. If there is a conflict between the General Contest Rules and the Rules for this Contest, the Rules for this Contest shall control. 

     

    1. HOW TO ENTER 

     

    1. The Contest will begin on Wednesday, March 23, 2022 and end on Friday, March 25, 2022.  

     

    1. To participate in the Contest, listen to the Station beginning on Wednesday, March 23, 2022 and ending on Friday, March 25, 2022 between the hours of 6 a.m. Eastern Time (“ET”) and 9 a.m. ET for the announcement of the cue to call. Upon hearing the cue to call, the first (1st) caller (as announced on-air at the time of the cue to call) to the Station contest line at 910-323-9570 will have the opportunity to win a Prize by correctly guessing the exact first name of the previous Pass the Gas winner selected in the previous hour that day (“Winner”), upon confirmation of eligibility.  The designated caller will have one (1) chance of no longer than ten (10) seconds to guess the exact first name of the previous Winner. If the designated caller correctly guesses the exact first name of the previous Winner, the designated caller will win the Prize. If the designated caller’s guess is incorrect, the on-air personality will move on to the next caller. The on-air personality will continue to the next caller until a caller correctly guesses the exact first name of the previous Winner. The caller for the 6:00am ET cue to call will not have to guess the exact first name of any previous Winner and will automatically be awarded a Prize, upon confirmation of eligibility. 

     

    1. Station is not responsible for any failure of a caller to reach the Station contest line including but not limited to busy phone lines, misdirected calls, equipment breakdowns, or disconnections. Calls will only be accepted at the designated phone number.  At the time of entrant’s call, entrant will be required to provide all information requested including entrant’s full name, complete address (including zip code), day and evening phone numbers and date of birth in order to be eligible to win. P.O. Boxes are not permitted. In the event that the selected caller is disconnected, incorrectly guesses the exact first name of the previous Winner, or is found to be ineligible, the next eligible caller who successfully makes it through on the call-in line, correctly guess the exact first name of the previous Winner, and completes the call will be a Winner.  There is no limit to the number of times a listener may attempt to call in to win, but a listener may be a winner only once.     

     

    1. There will be up to a total of twelve (12) winners selected in the Contest. 

     

     

    1. ELIGIBILITY RESTRICTIONS 

     

    1. This Contest is open to all Station listeners who are 18 years of age or older as of the date of entry into the Contest, who are legal US residents and reside in North Carolina, except where prohibited by law. Winners must possess a valid, government-issued ID and show proof of residency to verify eligibility. 

     

     

    1. PRIZES 

     

    1. Up to twelve (12) Prizes will be awarded. Each Prize consists of a one hundred ($100) Visa gift card. Approximate Retail Value (“ARV”) of each Prize is $100. Prizes are provided by Black River Entertainment. 

     

    1. The gift card will be subject to the terms and conditions as set forth by the issuer of the gift card.  Gift cards are not refundable or transferable and may not be substituted or exchanged for cash or credit at any time, nor will gift cards be replaced if lost or stolen. 

     

    1. Prizes or prize certificates must be claimed at the office of the Station located at 1876 Bureau Dr., Fayetteville, NC 28312, Monday-Friday, during regular business hours (8:30 a.m. to 1 p.m. and 2 p.m. to 5:30 p.m.). Prize or prize certificate must be claimed within ninety (90) days of winning. Failure to claim Prize by the specified time will result in forfeiture of the prize. It is the winner’s sole responsibility to claim the Prize or prize certificate within the timeline provided in these Official Rules. 

     

     

    1. SELECTION OF WINNERS 

     

    1. Up to twelve (12) winners will be selected and notified on-air as described above. 

     

    1. Odds of winning a Prize on-air depend in part upon the number and order of calls received.   

     

    1. Entrants must listen to the Station to win a Prize but do not need to be present to enter or win a Prize.  

     

    1. Prize winners must confirm acceptance of prize within seven (7) days of winning, or risk disqualification and an alternate Prize winner will not be selected.   

     

    1. Decisions of Station management with respect to the Contest are final. 

     

     

    1. CONDITIONS 

     

    1. The Station reserves the right to end any contest or amend these rules upon announcement on air and by publication at www.WKML.com.  

     

    1. For website contests: By use of the Station’s website and by entering this Contest, entrants agree to the Station’s Terms of Service Agreement and to the use of Personal Information as stated in the Privacy Policy located at www.WKML.com.
